Khmelnytsk regional department of the Antimonopoly Committee of Ukraine recognised the actions of the TOV Ukrenergoaktyv (Zaporizhzhia) and PP Venomet Metal (Zaporizhzhia) as anticompetitive reconciliations resulting in distortion in the results of the bidding.

After considering the application of the Office of Security Service of Ukraine in Khmelnytsk Oblast, the department stated that business entities agreed their actions during carrying out open tendering procurement procedures on transformers in November 2012 by PAT Cherkasyoblenergo.

The investigation showed that the tenderers have submitted the identically processed documents though the identical execution peculiarities aren’t specified by the Customer’s requirements and aren’t established by public or other standards. Thus, tenderers exchanged the information or these bids were prepared by one tenderer. PP Venomet Metal and TOV Ukrenergoaktyv were the distributors of one supplier – PAT Zaporizhtransformator.

In 2012-2014, PP Venomet Metal and TOV Ukrenergoaktyv took part in ten public procurement procedures, in which TOV Ukrenergoaktyv with cheaper offers always was the winner and it confirms the technical participation of PP Venomet Metal in procurement.

PP Venomet Metal was fined 66 ths. hryvnas. In addition to fines, PP Venomet Metal won’t be allowed to take part in public procurements within three years.

Proceedings on the case concerning TOV Ukrenergoaktyv were dismissed on the grounds of the liquidation of the legal entity.
